l. ACKNOWLEDGEMENT OF RECEIPT OF PRIVACY NOTICE
Under the Health Insurance Portability and Accountability Act of 1996 (hereafter, “HIPAA”), you have certain rights regarding the use and disclosure of your protected health information (hereafter, “PHI”). This Privacy Policy ("Privacy Policy") describes the data protection practices of RxBeta Inc, (dba clinova.solutions), and its affiliates, including, AJB Medical, AJB Care PA (collectively," "we," "our," or "us"), including when you visit any Clinova.Solutions website that links to this Privacy Policy (including www.clinova.solutions collectively, our "Websites"); use any affiliated mobile applications (the "Apps") that link to or contain this Privacy Policy; or otherwise provide data to clinova.solutions. We refer to the Websites, Apps, and other services provided by Clinova.Solutions together in this Privacy Policy as the "Services." This Privacy Policy is incorporated into our Terms of Use. All capitalized terms used in this Privacy Policy but not defined herein have the meanings assigned to them in the Terms of Use.
We obtain information about you through the means discussed below when you use the Services. Please note that we need certain types of information so that we can provide the Services to you. If you do not provide us with such information, or ask us to delete it, you may no longer be able to access or use part or all of our Services.
We gather various categories of information that you choose to share with us. This may occur when you:

The type of information we receive depends on how you interact with our Services and the details you provide. Examples include:

Personal identifiers such as your full name, mailing address, phone number, date of birth, and email

Payment and billing details (e.g., billing/shipping address, credit or debit card number, verification code, and expiration date), collected securely by our payment processors

Transaction records, including details of purchases, orders, or healthcare-related interactions

Sensitive Personal Information
In addition, we may process sensitive categories of information, including:

Health information: medical history, current symptoms, prescriptions, allergies, lifestyle details, genetic data, mental health, substance use, lab results, imaging, uploaded medical photos, and insurance information

Sexual health information, including sexual orientation or activity if disclosed in the course of care

Account security credentials, such as usernames and passwords you create

Sensitive demographic details, including race, ethnicity, or other legally protected categories

Identity verification materials, like government-issued ID numbers, driver’s licenses, or signatures (where required for compliance or notarization)

Communications content, including messages, attachments, and documents exchanged through the Services

Other details you voluntarily submit while engaging with our Services
We automatically gather details about how you interact with our Services and the devices you use to access them (“usage data”). As explained in this section, we and our third-party partners may rely on different technologies, such as cookies, software development kits, and related tools—to help capture this information. In certain cases, this data may qualify as sensitive personal information.
II. HOW WE MAY USE AND DISCLOSE HEALTH INFORMATION ABOUT YOU:
The following categories describe different ways that we may use and disclose health information. For each category of uses or disclosures we will explain what I mean and try to give some examples. Not every use or disclosure in a category will be listed. However, all of the ways I am permitted to use and disclose information will fall within one of the categories.
Our Websites: When you use our Websites, we collect and analyze information such as your IP address, browser types, browser language, operating system, the state or country from which you accessed the Services, software and hardware attributes (including device IDs) referring and exit pages and URLs, platform type, the number of clicks, files you download, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on particular pages, the terms you use in searches on our sites, the date and time you used the Services, error logs, and other similar information.
Location Information: When you use the Services, we and our service providers may automatically collect general location information (e.g., IP address, city/state and or postal code associated with an IP address) from your computer or mobile device. This information allows us to enable access to content that varies based on a user's general location (e.g., to provide you with accurate sales tax information and to deliver content customized to your location).
For Treatment Payment, or Health Care Operations: Federal privacy rules (regulations) allow health care providers who have direct treatment relationship with the patient/client to use or disclose the patient/client’s personal health information without the patient’s written authorization, to carry out the health care provider’s own treatment, payment or health care operations. We may also disclose your PHI for the treatment activities of any health care provider. This too can be done without your written authorization. We may also use your PHI for operations purposes, including sending you appointment reminders, billing invoices and other documentation including:

Operate, enhance, and manage the Services, including supporting physicians and other healthcare providers in delivering care, and ensuring they have the tools and resources needed for clinical and operational functions.

Provide customer service and technical assistance, including diagnosing and resolving errors or performance issues.

Communicate with you about your use of the Services, respond to your questions, and, when appropriate, send messages on behalf of your treating providers.

Confirm your identity and manage your account, including processing payments, fulfilling orders, and verifying government-issued identification when required.

Conduct internal studies to evaluate and refine the Services and gain a deeper understanding of our users. Any published or shared findings are presented only in de-identified or aggregated formats so individual users cannot be identified.

Optimize the way content and features are presented across devices, enable interactive functions, and help maintain the safety and security of the Services.

Assess user interests and needs through analytics and research in order to tailor and improve your experience.

Contact you (as permitted by law) via email, phone, or mail regarding surveys, promotions, events, or offerings from Clinova, our affiliates, or select partners.

Deliver customized advertisements and personalized content, and measure the reach and effectiveness of these communications.

Meet our legal and regulatory obligations in good faith.

Protect our rights and those of others by investigating or defending against claims, preventing fraud, and responding to unlawful or harmful activities
Disclosures for treatment purposes are not limited to the minimum necessary standard. The word “treatment” includes, among other things, the coordination and management of health care providers with a third party, consultations between health care providers and referrals of a patient for health care from one health care provider to another.
Lawsuits and Disputes: If you are involved in a lawsuit, We may disclose health information in response to a court or administrative order. We may also disclose health information about you or your minor child(ren) in response to a subpoena, discovery request, or other lawful process by someone else involved in the dispute, but only if efforts have been made to tell you about the request or to obtain an order protecting the information requested.
For the purposes discussed in this Privacy Policy, we may combine the information that we collect through the Services with information that we receive from other sources, both online and offline, and use and disclose such combined information in accordance with this Privacy Policy.We may aggregate and/or de-identify any information collected through the Services so that such information can no longer be linked to you or your device ("Aggregate/De-Identified Information"). We may use Aggregate/De-Identified Information for any purpose, including for research and marketing purposes, and may also disclose such data to any third parties, including advertisers, promotional partners, and sponsors.
We collaborate with various third parties—including healthcare professionals, pharmacies, and other service partners, as well as advertising networks, analytics vendors, marketing affiliates, and search providers—to help deliver and improve our Services. In some cases, these third parties may share additional information about you with us.
Online Analytics and Advertising
Online Analytics: We may use third-party web analytics services (such as those of Google Analytics -including Google Signals, Google User-ID, and other Google Analytics features- Metabase, Amplitude, and MixPanel) on our Services to collect and analyze usage information through cookies and similar tools; engage in auditing, research, or reporting; assist with fraud prevention; try to locate the same unique users across multiple browsers or devices to better tailor services and features; and provide certain features to you. If you have a Google account with personalized advertising enabled, through Google Signals, Google will also be able to gather for us analytics and engagement information from across the various devices you use to access the Services. To prevent Google from using your information for analytics (including cross-device tracking for personalization purposes), you may install the Google Analytics Opt-out Browser Add-on by clicking here. And to opt out of Google Signals, please open your "Settings" app, locate and tap "Google," select "Ads," and turn ON "Opt out of Ads Personalization." You may also be able to disable cross-device tracking through your Android or Apple device-based settings.
If you receive email from us, we may use certain analytics tools, such as clear GIFs to capture data such as when you open our message or click on any links or banners our email contains. This data allows us to gauge the effectiveness of our communications and marketing campaigns.
The Services may integrate third-party advertising technologies (e.g., ad networks and ad servers such as Facebook, Google Ad Words, TikTok, Criteo and others) that use cookies, pixels, and other technologies to deliver relevant content and advertising for Clinova.Solutions products and research on the Services, as well as on other websites you visit and other applications you use. The ads may be based on various factors such as the content of the page you are visiting, information you enter such as your searches, demographic data, and other information we collect from you. These ads may be based on your current activity or your activity over time and across other websites and online services.
We sometimes provide our customer information (such as email addresses) to service providers, who may "match" this information in de-identified form to cookies (or mobile ad identifiers) and other proprietary IDs, in order to provide you with more relevant ads when you visit other websites and mobile applications. We may also disclose customer information such as your email address with third-party advertising networks that use such information to better target advertising to you regarding Clinova.Solutions products and services, as well as other products and services, as you browse the internet.
If you are interested in more information about tailored browser advertising and how you can generally control cookies from being put on your computer to deliver tailored advertising, you may visit the Network Advertising Initiative's Consumer Opt-Out link, the Digital Advertising Alliance's Consumer Opt-Out link, or Your Online Choices to opt-out of receiving tailored advertising from companies that participate in those programs.To opt out of Google Analytics for display advertising or customize Google display network ads, visit the Google Ads Settings page. To update your advertising preferences with Facebook, click here. To update your advertising preferences with TikTok, click here. We do not control these opt-out links, whether these opt-out links change over time, or whether any particular company chooses to participate in the industry opt-out programs listed above. We are not responsible for any choices you make using these mechanisms or the continued availability or accuracy of these mechanisms.

Please note that if you exercise the opt out choices above, you will still see advertising when you use the Services, but it will not be tailored to you based on your online behavior over time.
Mobile Advertising: When using Apps or others, you may also receive tailored in-application advertisements. We may use third-party service providers to deliver advertisements on mobile applications or for mobile application analytics. Each operating system, iOS for Apple phones, Android for Android devices, and Windows for Microsoft devices provides its own instructions on how to prevent the delivery of tailored in-application advertisements. We do not control how the applicable platform operator allows you to control receiving personalized in-application advertisements; thus, you should contact the platform provider for further details on opting out of tailored in-application advertisements. You may review the support materials and/or the device settings for the respective operating systems to opt-out of tailored in-app advertisements. Do Not Track ("DNT") is a privacy preference that users can set in certain web browsers. We are committed to providing you with meaningful choices about the information collected on our Websites for third party purposes, and that is why we provide the variety of opt-out mechanisms listed above. However, we do not currently recognize or respond to browser-initiated DNT signals. To learn more about Do Not Track, you can do so here. Please note that “Do Not Track” is a distinct privacy mechanism from the browser-based opt out signals referenced below in the "Your Rights and Choices" section, which Clinova.Solutions does honor in accordance with applicable law.
We may disclose your information for our business purposes in the following ways:
We may share your information with affiliates and related entities within the Clinova.Solutions group to help deliver care, maintain consistency across our offerings, and improve your overall experience:
Affiliates and Subsidiaries: Your information may also be shared with licensed healthcare providers, pharmacies, or other healthcare organizations when necessary to schedule and complete appointments, provide treatment or pharmacy support, or otherwise facilitate care, payment, or healthcare operations at your request.
Health Care Providers and Services:In addition, we rely on carefully selected third-party service providers to support our operations. These partners may assist with billing and payment processing, laboratory and diagnostic services, technology and hosting, data storage, marketing, analytics, research, customer support, order fulfillment, shipping, fraud prevention, IT security, compliance, and auditing.
Advertising Networks/Joint Product/Marketing Partners: For marketing purposes, and as described in the Online Advertising section, we may work with advertising networks and partners to deliver more relevant communications and to measure the effectiveness of our campaigns. We may also collaborate with other organizations to provide co-branded services or products. In those cases, such partners collect and use information under their own privacy policies, which we encourage you to review.
Business Transfers/Public Forums/User Interactions: We may disclose information when required by law or in good faith to comply with a legal process, enforce our Terms of Use or this Privacy Policy, investigate potential violations, respond to third-party claims, or protect the rights, safety, or property of Clinova.Solutions, our users, partners, or the public. We may also cooperate with fraud-prevention and cybersecurity efforts by exchanging information with other organizations.
Corporate Transactions: If Clinova.Solutions merges with, acquires, or is acquired by another organization, or if assets are transferred, user information may be part of the transferred assets. Where laws require, we will ensure that your data remains protected under applicable restrictions.
Public Forums and Interactions: Some areas of our Services allow you to post content (e.g., reviews, comments, or discussions). Any information you disclose in these spaces is not confidential and may be seen, shared, or indexed by others, including through search engines. Please exercise caution when posting publicly.
Aggregate/De-Identified Information/Consent: We reserve the right to create Aggregate/De-Identified Data from the information we collect through the Services and our disclosure of such Aggregate/De-Identified Data is in our discretion.We may also disclose your information in other ways you direct us to and when we have your consent.
III. CERTAIN USES AND DISCLOSURES REQUIRE YOUR AUTHORIZATION:
Telemedicine Notes: We keep telemedicine and clinical documentation notes as part of your medical record. These notes are protected under the HIPAA Privacy Rule (45 CFR Part 164). In most cases, I may use and disclose these notes without your written Authorization for purposes such as:
Treatment – providing, coordinating, or managing your health care, including consultations between providers.
Payment – activities needed to obtain reimbursement for the care provided.
Health care operations – activities such as quality improvement, training, auditing, and compliance.
Public health and safety – such as reporting infectious disease, preventing or controlling disease, or to avert a serious threat to health or safety.
Required by law – such as health oversight activities, judicial proceedings, or law enforcement purposes.
Coroners/medical examiners – as necessary to perform their legal duties.
For compliance review – by the Secretary of Health and Human Services (HHS) to investigate HIPAA compliance.

Illl. USES OF ARTIFICIAL INTELLIGENCE TOOLS
Clinova.Solutions utilizes artificial intelligence (AI) tools to support and enhance our Services and improve the overall user experience. We may apply AI for legitimate business purposes, including: tailoring content and recommendations, increasing the efficiency and accuracy of our platforms, assisting our support team with AI-powered responses, identifying usage patterns to refine our offerings, and helping to detect or prevent fraudulent or unsafe activity. Importantly, while AI may aid in these processes, all significant healthcare-related decisions remain subject to review and approval by licensed clinicians.
Any information processed through AI is handled in accordance with the same privacy, security, and data rights protections outlined in this Policy. At times, we may engage third-party AI providers, but they are carefully vetted under our vendor management protocols and are required to follow appropriate data protection standards.
V. CERTAIN USES AND DISCLOSURES REQUIRE YOU TO HAVE THE OPPORTUNITY TO OBJECT.
Disclosures to family, friends, or others: You have the right and choice to tell me that Clinova.Solutions may provide your PHI to a family member, friend, or other person whom you indicate is involved in your care or the payment for your health care, or to share your information in a disaster relief situation. The opportunity to consent may be obtained retroactively in emergency situations to mitigate a serious and immediate threat to health or safety or if you are unconscious.
State-Specific Notices

California Residents (CCPA/CPRA): You have rights to opt out of data “sharing” for targeted ads, request access or deletion, and limit use of sensitive personal data. If you reside in California, the California Consumer Privacy Act (“CCPA”) requires that we provide additional details about how we handle your information. Specifically, we must explain: (1) the purposes for which each category of “personal information” and “sensitive personal information” (as those terms are defined under the CCPA) is used; and (2) the categories of third parties to whom we may (a) disclose such information for business purposes, (b) “share” it for cross-context behavioral advertising, or (c) “sell” it. Under the CCPA, “sharing” refers to the use of a consumer’s personal information to deliver targeted advertising based on their activity across different websites or services, while “selling” means disclosing personal information to another party in exchange for money or other valuable consideration. We may “share” certain information to deliver advertising that is more relevant to you and better aligned with your interests. In some instances, our use of third-party analytics tools and online advertising platforms may involve the disclosure of online identifiers—such as cookies, IP addresses, device IDs, or usage data—in ways that the CCPA considers to be a “sale.”

This information is shared with payment processors, affiliates, and service providers for payment processing, security, and compliance purposes. We do not sell or share financial information for advertising.

This information may be shared with service providers or affiliates to provide and improve Services or comply with legal obligations. We do not sell or share this type of data for advertising purposes. -
User-Generated Content (such as posts, reviews, or messages shared through the Services).
This may be shared with service providers, affiliates, and fraud-prevention entities. It is used to operate the Services, improve user experiences, and comply with legal obligations. We do not sell or share this type of information for advertising. -
Customer Support Information (such as data shared in chats, calls, or help requests).
This may be disclosed to service providers, affiliates, and healthcare providers. It is used to resolve technical or service-related issues, improve operations, and comply with applicable law. We do not sell or share this data for advertising. -
Health Information (such as symptoms, medical history, prescriptions, or telehealth visit details).
This information may be shared with affiliates, service providers, healthcare professionals, and fraud-prevention entities. It is used to provide and coordinate medical care, improve Services, support analytics, and meet compliance obligations. Certain health-related data may also be used with advertising partners in limited ways permitted by law. -
Sensitive Personal Data (such as information about sexual orientation, race/ethnicity, or identity verification details).
This may be disclosed to service providers, affiliates, healthcare professionals, and entities for legal or fraud-prevention purposes. It is used to provide Services, comply with legal obligations, and improve operations. We do not sell or share this type of information for advertising. -
Communications (such as the contents of messages sent via the Services).
This may be disclosed to service providers, affiliates, healthcare providers, or fraud-prevention entities. It is used to deliver and support Services, improve operations, and comply with legal requirements. We do not sell or share this type of information for advertising.
Your Choices Regarding “Sharing” and “Selling”
As explained in the Your Rights and Choices section of this Privacy Policy, California residents have the right to opt out of the “sharing” or “selling” of personal information for purposes of targeted advertising or analytics. This may include the use of cookies, pixels, and similar tracking tools. If you wish to opt out, you can adjust your privacy preferences through our “Your Privacy Choices” page.
We also honor legally recognized browser-based opt-out signals (such as the Global Privacy Control) to the extent required by law. In addition, we may share hashed email addresses with advertising partners to provide more relevant promotions; you may opt out of this practice by completing the opt-out form provided.
Clinova.Solutions does not knowingly sell or share the personal information of children under the age of 16.
Other CCPA Rights.

Incentive Programs. The Services may offer opportunities to receive certain services or benefits such as gift cards, discounts, or free services, which may require the provision of Personal Information. Such opportunities could be considered a financial incentive under applicable law (each, an “Incentive Program”). When you participate in an Incentive Program, you agree to the terms of that Incentive Program, and may revoke your participation depending on the Incentive Program (e.g., by opting out of emails). To the extent we can determine the value of your information, we consider the value of providing you with a more personalized experience as well as the expenses we incur in providing Incentive Programs that are reasonably related to the costs associated with offering the Incentives.

Right to Limit. The CCPA also allows you to limit the use or disclosure of your “sensitive personal information” (as defined in the CCPA) if your sensitive personal information is used for certain purposes. You have a right to limit our use of sensitive personal information for any purposes other than to provide the services or goods you request or as otherwise permitted by law (for example, you have the right to opt out of our use of information about the Clinoa.Solutions treatments you have received to opt out of receiving targeted online advertisements about similar products and services that might be of interest to you). To opt-out from such additional purposes, please email the jasmine@pinnaclehealth.vip page or use the Global Privacy Control described in the “Your Rights and Choices” section of this statement.

Shine the Light Disclosure. The California "Shine the Light" law gives residents of California the right under certain circumstances to request information from us regarding the manner in which we disclose certain categories of personal information (as defined in the Shine the Light law) with third parties for their direct marketing purposes. We do not disclose your personal information to third parties for their own direct marketing purposes

Colorado Residents: You may appeal denials of rights requests and limit processing of sensitive personal data.

Texas Residents: Texas law requires specific notice when sensitive health data is processed or disclosed. Clinova.Solutions does not sell your sensitive data.

Nevada Residents: You may opt out of the sale of your personally identifiable information under Nevada law. However, if you are a Nevada resident who has purchased services from us, you may submit a request to opt out of any potential future sales under Nevada law by emailing jasmine@pinnaclehealth.vip. Please note we will take reasonable steps to verify your identity and the authenticity of the request. Once verified, we will maintain your request in the event our practices change.
VI. YOU HAVE THE FOLLOWING RIGHTS WITH RESPECT TO YOUR PHI:

The Right to Request Limits on Uses and Disclosures of Your PHI. You have the right to ask me not to use or disclose certain PHI for treatment, payment, or health care operations purposes. I am not required to agree to your request, and I may say “no” if I believe it would affect your health care.

The Right to Request Restrictions for Out-of-Pocket Expenses Paid for In Full. You have the right to request restrictions on the disclosure of your PHI to health plans for payment or health care operations purposes if the PHI pertains solely to a health care item or a health care service that you have paid for out-of-pocket in full.

The Right to Choose How I Send PHI to You. You have the right to ask me to contact you in a specific way (for example, home or office phone) or to send mail to a different address, and I will agree to all reasonable requests.

The Right to See and Get Copies of Your PHI. Other than in limited circumstances, you have the right to get an electronic or paper copy of your medical record and other information that I have about you. Ask us how to do this. I will provide you with a copy of your record, or if you agree, a summary of it, within 30 days of receiving your written request. I may charge a reasonable cost based fee for doing so.

The Right to Get a List of the Disclosures I Have Made.You have the right to request a list of instances in which I have disclosed your PHI for purposes other than treatment, payment, or health care operations, ans other disclosures (such as any you ask me to make). Ask me how to do this. I will respond to your request for an accounting of disclosures within 60 days of receiving your request. The list I will give you will include disclosures made in the last six years unless you request a shorter time.
